HELP! My business was broken into over two years ago! This was racially motivated for sure and we had building insurance, and coverages on our property. Somehow, the township police department took an hour to respond although the police station is within 2 miles walking distance of the store. Instead of them assisting me as the victim, the began very early in the process treating me as the criminal. They fingerprinted me, interrogated me and my sister wrongfully and as soon as I retained an attorney they dropped the entire investigation with no assistance to me. State Farm our former insurance company wrongfully denied my case due to racial motivation. I am losing everything i have while trying to fight this case all by myself. It is the holidays and I am struggling to support my family due to the loss of my entire business! I am seeking help of any kind as I go through this difficult fight all by myself. My business was robbed, vandalized and destroyed with no assistance or help from law enforcement nor my insurance company Instead of treating me as the victim, I was investigated as a criminal although I've never been in trouble in my life! They wrongfully denied me, didn't properly investigate my claim, made derogatory comments about my clothing and defamed my character to the entire community! Please assist!

ANY HELP OR ASSISTANCE THANK YOU SO MUCH! Funds will be used to re-open my business in a different area to continue to serve the elderly. Our products were used for ailments such as Arthritis, Cancer, Aches and Pains as an alternative method of treatment using natural medicines. The funds that we are raising is to purchase another location, puchase inventory and rebuild our business as we continue to await court proceedings. We have been wrongfully denied, accused and treated as a criminal from the entire community that I have worked professionally in for the past 10 years. Years ago, I started out as the finance manager at the biggest dealership in this entire community. Because of this, I was able to secure a very lucrative financial life for my wife and children to support them. Not only that, as my name grew, my popularity also grew within this same community with most of the executives of Swanton township which afforded me benefits not afforded to anyone else African American in that entire community because there are very few in the entire community to begin with. The time came when I decided to resign my position at the dealership because I started learning and training about cbd products. Then after a few successful lucrative sales in CBD, it was now time to open my own retail location. Because of my reputation and who I used to be in that community, I didn't even have to follow any of the standard rules every other business does to secure permission because the mayor and I were very close at one point almost to the point where he literally would log on to Facebook almost every night just to watch me sing karaoke or play instruments. The first location we were allowed to do business at, was rented to us by a complete racist scam of a landlord named Mike Wells. From the moment he rented to us, he began taking advantage of us, overcharging us for very limited space, trying to make us repair the roof issues although we were rented tenants with a lease, as well as automatically shutting the lights off on myself and my staff everyday at 5p regardless if we had customers in the building or not. This scam only lasted for about 3 months before I became fed up with Mr. Wells and his shenanigans so I then took to social media in search of another location for lease in that area. Throughout my search on Facebook, a lady by the name of Deborah McSurley contacted me about a building that she had available that belonged to her deceased father's trust. After meeting me just one time, she made the decision to not only lease to me the space we first discussed and saw, but agreed to let me take possession of the entire almost 5000 sq ft building which was amazing. I agreed to the deal however, she never told the previous business owner that I would be taking possession of the building that she's been doing business in for over 20 years. The previous tenant found out throughout the community which led to backlash from the community about how "wrong" I was to completely put a business out of business which I had nothing to do with to begin with. However we took possession of the building under a recorded land contract and that is when it all began. The place was an entire DUMP when we gained possession with myself and my wife spending our entire life savings rehabbing what was soon to be our place of business. After about 2 months we finally announced it to the community and had a grand opening ceremony on main st with the mayor and the local press. From that point forward we became very well known in the entire community with my former dealership sending us referrals as well as the only physical therapist's office in town also sending us clients. Most of all of our clients were 60 and older taking our products for treatment of ailments such as arthritis. diabetes ETC. We were not just the regular vape and e-cigarette shop. In the short 8 months that our store was open, we generated over $130,000 in retail sales as well as obtained over 100 perfect 5 star ratings on google search. On January 17, 2022 in the early hours of the morning, I was alerted that my store alarms were going off. I live almost 30 minutes from the former store. The all white police department is literally in walking distance from the store yet it took them an entire hour to arrive on the scene which makes no sense because the patrol cars literally pass the store several times throughout the day as our store stood directly on Main st downtown Swanton right next door to their popular pizza place Tanos. By the time I arrived at the store we were robbed, property had been sodomized, The racial slur of "Nigger" spray painted on the walls and complete destruction of everything my wife and I had built and they had an entire hour to do it! Instead of State Farm treating me as the victim, from the very first moment, State Farm treated me like a criminal. They fingerprinted me, interrogated me as well as my sister (former employee) trying to set us against one another. At this point I became very disgusted and decided to retain my first Attorney by the name of Dennis Sawan. Six days after the incident, State Farm made the decision to stop paying my claim after one small payment with no discussion as to why and chose to investigate me. Although it took them an entire 210 days to make a decision to finally deny the claim in August after someone disclosed to my Landowner the status of the claim being denied. She then decided to lock me out of the building taking possession of all of what we had remaining in our possession. Because it was a Land contract according to Dennis, she had the right to take possession of my property which still doesn't make any sense. Just like it doesn't make any sense how she was able to find out information about my policy without me giving it to her. State Farm took me through a 6 hour deposition questioning where they acted not only my personal character the entire time, but they also even attacked my clothing attire. Publishing a statement such as "The insured is braggadocious, dressed in a royal blue suit with a LOUD tie and a bunch of jewelry" Which painted me as a drug dealer. I am not stupid but I don't even know how they can get away with that. Nevertheless I sat through this scam line of questioning and after several requests by Dennis for an update from State Farm regarding the status of the claim after 210 days they decided to deny the claim based upon "Plaintiff willing destroyed his own business or had someone else to do it" completely ignoring the fact that if I had anything to do with the breaking in of my own business, how would've I or anyone else I know could've knew the police were going to be an entire hour late? I have never been charged with a crime in my entire life at almost 40 years old, but yet they can publish this falsehood without any evidence? Also if that is the reason they denied, where are the charges filed against me from State Farm? How can you tell the public that information, completely destroying my reputation in the entire community. I once sat on the small business administration planning board in that community and now the entire community ousted me all at one time including the mayor. Dennis somehow could foresee the denial coming but advised me that I definitely need to bring action against them for bad faith. He further advised me that he was planning to move to Florida and would not be able to assist me but would refer me to one of his buddys supposedly the best in the business as far as handling insurance matters. Zach Desilivis agreed to take on the case and began preparing for the file. In the beginning, he filed actions against my former landowner McSurley, State Farms special investigations unit, Bryan Acornely, State Farm as well as my former agent Jeff Lambert whos office was also a block from my store but the day of the incident he ignored my calls and texts to the point where I made the decision to call customer service which did not go over to well with him either. We filed defamation of character, bad faith, as well as breach of contract against State Farm. I provided over 3000 pages of documents everything asked of me I provided with no delays. The first white privilege scam that happened was my attorney somehow convinced me to sign off of the building to release it back to McSurley because she couldn't sell it because I was listed as the land contract holder. Zach supposedly got her to agree to us releasing the building in exchange for her signed affidavit disclosing who disclosed information about me to her. She agreed to do this in the beginning and was supposed to have it completed by a scheduled date. Not only did she decide to not sign the affidavit she agreed to sign, but completely ignored the deadline set by the court. Nothing was done about it while all along she stole whatever inventory, personal effects, store furniture, security cameras ETC that we had left and now we were robbed for a second time, this time State Farm KNEW who it was but nothing was done. At this point she regained possession of the building, sold it for a profit and I lost because she refused to sign? We agreed to drop all charges against her personally for her testimony then at the direction of her attorney according to Zach she just changed her mind after this was set by the courts? I think we all know what would've happened if I ignored scheduled dates or just refused to do something that I agreed to, especially in this town. State Farm then decides to hire an outside accounting firm out of New York whom according to them made the determination about what they claimed was in our stores possession, cash transactions, cbd as well as "other data" and their final SCAM conclusion was that my total inventory as about $60.000 not the $600,000 we originally claimed with zero evidence besides the documents that I provided to them. Fast forward to this year, My wife and I have been diligently waiting for our day in court which was supposed to begin next week but according to Zach, the judge made a summary judgment decision on Friday denying the bad faith part of the claim after we have already dropped defamation of character for no reason because he advised me that is what we needed to do drop the defamation and focus on the bad faith. Well that is what we did so I thought and finally after almost 2 years of waiting I would get my chance in court. Then with only a few hours of notice my current attorney made the decision to dismiss the claim all together without prejudice which according to him gives me the chance to file again and start over. However, by HIS advice and recommendation, I need to do myself a service and see if I can get YET another legal team to take this case over and re-file it as soon as possible. According to him, I need to search for one and he will be more than willing to prepare, brief or discuss anything about my case so my next attorney is fully prepared. We were supposed to have our day in court this past Monday, however I was told settlement negotiations were underway and if a settlement was not going to be reached, he was going to dismiss and refile. He gave me the option to re-filing it with him, but WHY would I even trust that when he just let me and my entire family down after waiting on a solution for almost two years. Not only that he stated SEVERAL times that in his professional opinion the judge made the wrong ruling. Whatever the scam is somewhere the ball was dropped and I was not defended properly by this guy! My entire life has been changed at the hands of the Swanton Police department, State Farm and not only that they didn't even question not one of the suspects that I gave them at their request of who it could've been. One of those suspects was our former landlord Mike Wells who every day since we moved out of his building literally drove past our store and harrassed myself and my employees laying on his horn, yelling obscenities, ETC to the point where I made a complaint to the police with nothing being done about it at all. Below is the final email that I sent to Zach's office concerning my thoughts of this entire situation. I truly pray that The Most High connects me with somebody that looks like me that can truly help me. I am tired of the runaround, the lies and the obvious superior treatment that all in this situation have received all except me. They not only did all of this to me but also published these false statements about me throughout the entire community. Now I look like a criminal and my entire professional reputation has been forever ruined not to mention the income they also stole from me this entire time as well. I also handed this same so-called attorney my daughter's car accident to handle as well with the insured driver who was driving a big Silverado literally ran into the back of my daughter's vehicle and todate vehicle has not been repaired, chiropractor bills have not been paid, my grandson was in the backseat and was only 2 years old at the time and is autistic as well as thousands of dollars in medical bills pain and suffering that this guy just ignored and the guilty party ADMITTED and SIGNED admitting fault/guilt! Makes ZERO sense why almost a year later not one of her bills have even been paid either! As of today our entire business was stolen from us, what remaining products we had left, the land owner illegally sold what was left after changing the locks without any notice. State Farm unfairly discriminated against me and commited Bad faith, Defamation of character as well as Breach of contract. The police department racially discriminated against me by treating me as a criminal instead of the victim. As of today my entire business that I built from the ground up has been destroyed and the building sold right from under us! Just so nobody thinks this is a scam or some type of a game, I have attached all of the court filed documents including the trial brief which spells out exactly what happened to me and my family over these past two years.
