VOLUNTEER LIABILITY WAIVER AND RELEASE OF LIABILITY

1. Acknowledgment and Assumption of Risk

I understand that participation in ORAI’s Bay Rescue Day (the “Event”) involves voluntary outdoor physical activity, including but not limited to walking on uneven or slippery surfaces, lifting and carrying debris, exposure to weather conditions (including heat and sun), and potential contact with sharp, hazardous, or contaminated materials.

I knowingly and voluntarily assume all risks associated with participation in the Event, whether known or unknown, including but not limited to personal injury, illness, property damage, permanent disability, or death.

2. Release and Waiver of Liability

In consideration of being permitted to participate in the Event, I hereby RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS Ocean Rescue Alliance International (ORAI), its directors, officers, employees, volunteers, agents, representatives, sponsors, partners, and affiliates (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, or liabilities arising out of or related to my participation in the Event.

THIS RELEASE INCLUDES ANY CLAIMS BASED ON THE NEGLIGENCE OF THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY THE LAWS OF THE STATE OF FLORIDA.

3. Indemnification

I agree to indemnify and hold harmless the Released Parties from any and all claims, damages, liabilities, costs, or expenses (including reasonable attorney’s fees) arising out of or related to my participation in the Event or my failure to comply with safety instructions.

4. Medical Treatment Authorization

I certify that I am physically capable of participating in the Event. I understand that ORAI does not provide medical insurance coverage for participants. In the event of an injury or medical emergency, I authorize ORAI to secure emergency medical treatment on my behalf if necessary. I agree to be fully responsible for any medical costs incurred.

5. Compliance with Safety Guidelines

I agree to follow all safety rules, instructions, and guidance provided by ORAI representatives and to use provided equipment appropriately. I understand that failure to follow safety guidelines may result in removal from the Event.

6. Media Release

I grant permission to Ocean Rescue Alliance International to photograph, video record, or otherwise document my participation during the Event. I authorize ORAI to use such media for promotional, educational, fundraising, or marketing purposes without compensation.

7. Minors

If the participant is under the age of 18, this waiver must be signed by a parent or legal guardian. The parent or guardian agrees to all terms of this waiver on behalf of the minor and accepts full responsibility for the minor’s participation.

8. Governing Law and Severability

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Florida. If any provision of this waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Acknowledgment and Agreement

By registering for and/or participating in ORAI’s Bay Rescue Day, I acknowledge that:

I have read this entire Liability Waiver and Release carefully.
I understand its contents and legal effect.
I agree to its terms voluntarily and without coercion.
I understand that by registering, I am waiving certain legal rights, including the right to bring certain claims against Ocean Rescue Alliance International and the Released Parties.

By completing my registration, I affirm my agreement to this Waiver and Release of Liability.
