Adventure Bags, Inc. will host their 12th Annual Debbie Gori Memorial Ride on Saturday, Sept. 30, 2023. The event will be held at the Winder Moose Lodge. Registration will begin at 9am. Kickstand Up at 11am. The event will include an escorted scenic Ride followed by lunch being served to all participants. We will have door prizes, Raffles, Silent Auction, & more. All proceeds will benefit Adventure Bags, Inc. mission to serve Georgia's most vulnerable children...One bag at a time. *** Signed Release and waiver of liability and indemnity agreement MUST accompany registration form in order to participate. Release and waiver of liability and indemnity agreement IN CONSIDERATION for being permitted to participate in the ADVENTURE BAGS event benefiting ADVENTURE BAGS, Inc. (“Adventure Bags”). THE UNDERSIGNED: 1. HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE ADVENTURE BAGS; its affiliates; the officers, directors, management officials and volunteers assisting in the event; the sanctioning organization or any subdivision thereof; grounds operators, grounds owner, officials, promoters, sponsors, advertisers; owners and lessees of premises used to conduct the event and each of them, their officers and employees; all for the purpose herein referred to as “releasees,” from all liability to the undersigned, his or her personal representatives, assigns, heirs, and next of kin for any and all loss or damage, and any claim or demands therefore on account of injury to the person or property or resulting in death of the undersigned, whether caused by the negligence of the releasees or otherwise while the undersigned is participating in the event. 2. HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the releasees and each of them from any loss, liability, damage, or cost (including attorney’s fees) they may incur due to the presence of the undersigned participating in the event and whether caused by the negligence of the releasees or otherwise. 3. HEREBY AGREES that in order to participate in this event, undersigned rider/driver must provide/present a valid operator’s license and proof of personal injury and property damage liability insurance coverage. 4. HEREBY AGREES that while participating in the event, he or she will not ride while under the influence of alcohol or any substance that affects the ability to operate or control his or her vehicle. 5. HEREBY AGREES that he or she will not use or operate any vehicle in violation or contravention of any city, county, state or federal laws, statutes, ordinances or regulation and shall be personally liable for all fines and penalties for traffic law violations. 6. HEREBY AGREES to wear minimum safety apparel as required by state law. Minimum safety apparel for these purposes may include a DOT-approved safety helmet. Rider and passenger are strongly advised to wear a helmet whether required to do so by law or not, and are strongly advised to wear glasses, goggles, or a face shield, and additional protective outerwear such as gloves, long-sleeved jacket, boots, and long trousers while participating in the event. Rider and passenger understand and acknowledge that failure to wear proper safety apparel may result in the rider or passenger’s injury or death. 7. HEREBY ASSUMES FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE due to the negligence of releasees or otherwise while participating in the event. EACH OF THE UNDERSIGNED expressly acknowledges and agrees that the activities of the event are dangerous and involve the risk of serious injury and/or property damage. THE UNDERSIGNED further expressly agrees that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the state in which it is operated and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. Any legal action or proceeding relating to and any claim arising out of the Undersigned’s participation in the Adventure Bags event shall be brought in State or Federal Court having jurisdiction over Barrow County, State of Georgia, USA. The Undersigned irrevocably and unconditionally waives (and agrees not to plead or claim) any objection to the laying of venue of any action, suit, or proceeding arising out of their participation in the Adventure Bag’s event in such court and or that any such action, suit, or proceeding brought in any such court has been brought in an inconvenient forum. THE UNDERSIGNED HAS READ AND VOLUNTARILY SIGNS THE RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT, and further agrees that no oral representations, statements or inducements apart from the foregoing written agreement have been made. THE UNDERSIGNED ALSO ACKNOWLEDGES THAT participation in this Adventure Bags event may be recorded (whether by means of audio, visual, and/or photographic means) (the “Materials”). The Undersigned hereby RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE releasees from and against any and all Liability in any manner connected with the use and exercise of the rights granted and/or arising out of or related to the use or reuse of the Undersigned’s appearance, name, voice, image, likeness and/or biographical information as they may appear in the Materials (including without limitation, claims based upon harm to reputation, disparagement, invasion of privacy and/or publicity) in connection with the Materials. The Undersigned hereby authorizes Adventure Bags to use the Materials for any purpose whatsoever, including but not limited to, the advertising, promotion, and/or merchandising and further acknowledge that such recordings may be exploited in any media now known or hereafter devised, throughout the world, in perpetuity. The undersigned understands that he or she shall not be entitled to any compensation in connection with any use of the Materials. THE UNDERSIGNED ALSO AGREES that by providing a mailing and/or email address, he or she is opting in to receive communications from the ADVENTURE BAGS. The undersigned may opt out at any time by contacting ADVENTURE BAGS. NOTE: Drawing void where prohibited or restricted by law. Must be present to win drawing prizes. The drawing is open only to U.S. citizens who are 18 years of age or older at the time of entry and have reached the age of majority in their state of residence. MINORS UNDER THE AGE OF 18 must have a parent or legal guardian present to sign a written waiver for each minor to participate and/or ride in a ADVENTURE BAGS event.
