His Story

Anthony Devon Mack Jr, born August 12, 2002 is an all-star scholar and athlete. Upon graduating co 2020 from McClymonds High School in Oakland, CA with honors Anthony walked the stage short a few credits from receiving his AA degree in Business Administration. He accomplished this because of his dual enrollment at Peralta Colleges earning GE credits during his Jr. & Sr. years of High School while also taking AP courses. Anthony worked hard to maintain his exceptional GPA and outstanding athletic record. As a result, he was awarded a 50/50 academic/athletic scholarship to attend Western Oregon University.

Anthony accepted the scholarship to attend WOU and during this time he remained an honor student and excelled in football, becoming the fastest on his team, the 2nd second fastest in the state of Oregon in 2021 and the #1 in the division for blocked kicks. Anthony has remained throughout his school years motivated, focused and dedicated to hard work which takes a ton of discipline to accomplish.

During covid the world experienced so many life changing hardships, well Anthony Jr. was no stranger to experiencing his own misfortunes during these trying times. In March 2021 part of Anthony’s athletic portion of his scholarship was reduced and he had to begin working to supplement the loss. In December of 2022 Jr decided he wanted to transfer. in March, 2023 Anthony Jr. entered the transfer portal for the opportunity to transfer to another school so that he can benefit from his hard work and dedication of being an honor student and exceptional athlete; this was his ticket to pay for college, his motivation and dedication to his future as a Business Major was secured by the hard work he continuously put in. Well shortly after making the decision in March 2023, 1 week after the decision to prepare to transfer from WOU false accusations and charges were brought forth by his coworker/schoolmate for sexual assault and Anthony Jr. was suspended from WOU and fired from his job..

After 16 months of legal battles the bench trial went underway once the accuser was available after legal charges that were brought up against her she was able to align her schedule so that she can be available to testify in this trial. In short, trial day 1; July 9, 2024 the Judge dismissed and acquitted the charges of sodomy, coercion and sexual abuse but trial day 2; July 10, 2024 he found Anthony Jr. guilty of rape, stating “I believe her”, was the Judge’s comment on the stand. July 9, 2024 prior to being detained Jr received notice of new offers for 2 colleges. Unfortunately, to date those opportunities he is unable to follow through on due to being detained. We believe and stand by Anthony Mack Jr., one because we know him to be an exceptional loving hardworking youngman with a bright future, second the trial revealed several critical points in which there was no evidence the alleged rape ever occurred: :

The medical examiner found no evidence of rape or recent sexual contact consistent with forced sex.
The employer, school nor police did formal investigations & nothing was reported on the night of the incident
Both the accuser & her mother admitted to waiting 6 days after the alleged incident to report it and see a doctor
No rape kit was done
The accuser went to a party a few hours after the alleged incident
The accuser said her clothes were lost from the night of the alleged incident
The accuser sent multiple text messages to Anthony Jr. asking him to come over and stay the night from the night the alleged incident occurred thru the 6 days later when she made her report, these text messages were known knowledge to the Judge
The officers involved in the case were dismissed during testimony for not following proper protocol according to their current police handbook.

Although this case lacks any evidence of rape, this was a bench trial and Anthony’s fate was left in the hands of 1 person, the Judge who found him guilty based solely on the accuser's testimony a white female mixed with black, however, her mother is white. I once heard a commentator say, “a white woman's cry is heard well over a black woman's cry. That’s unfortunate, but the truth we live in today. Polk County, a small county in the state of Oregon where Anthony’s trial took place. Per the US Census Bureau report from data last reported in 2020 the population of Polk County is 87,433 of which 78% (68,274) are whites and blacks/african americans who make up less than 1% (735) of Polk counties population. Monmouth, a small city within Polk county that is still known as a Sundown Town, where Anthony Jr. lived, worked and attended school per the US Census Bureau_Monmouth has a population of 11,110 of which 74% (8,167) are whites and blacks/african american makeup less than 1% (347).

We believe this decision is purely based on discrimination and we believe in Jr’s innocence. We are blessed to have had over 50 character letters submitted to the judge within a 5 day timeframe so that he can see Jr. as the young man we know him as. Although the judge was impressed and saw Jr., in a different light than what was painted of him during trial and the prior decision to dismiss the other 3 charges, Oregon's M11 law mandates 100 months for a rape charge. As a result, the Judge handed down the minimum sentencing of 100 months. We have faith and believe that this will be overturned because the evidence proves there was no rape. Leaders from the Washington and Arizona NAACP chapters have been instrumental in getting us connected with a new Attorney. Although I haven’t spoken to the entire defense in this appeal letter, I hope that you can see this as the injustice it is. We are sharing because we need $45k to help our son to cover appellate legal expenses & provide support for Anthony Jr. during this time. We hope that you can donate whatever is placed on your heart, no contribution is too small.
