No family should have to spend tens of thousands of dollars just to bring a loved one home from immigration detention.

At Delaney Hall, families regularly tell us they have spent $10,000, $20,000, even $30,000 in legal fees trying to secure the release of a detained spouse, parent, or child. Many are pushed into debt while navigating a system designed to exhaust them emotionally and financially.

The need far exceeds available support. The Defense, Detention and Deportation Initiative (DDDI) — a State of New Jersey-funded program providing pro bono legal representation to detained immigrants — is overwhelmed and currently able to serve fewer than 20% of people in need.

Meanwhile, habeas petitions challenging illegal detention have an almost 90% success rate in federal court. But filing one can cost between $5,000 and $10,000. Even after winning release, many people are hit with devastating immigration bonds of $25,000 or more.

One formerly detained individual shared:

“I am so grateful that I could get released on a habeas after being detained for close to six months while I was losing my eyesight. Now I am released and can finally get the medical help I need.”

People are being detained right now without adequate legal support. Families are being forced to make impossible choices between paying rent, feeding their children, or trying to free a loved one from detention.
