BACKGROUND

New Community Vision has an exclusive option to acquire this more than 200-acre property. The property is a unique gem of the Grand Traverse Bay watershed and plays a key role in supporting important natural habitat, biodiversity, and coastal resiliency in the beloved and renowned Leelanau peninsula.

Developed as a campground called Timber Shores in the 1960s and 1970s, the property has remained idle for decades.

The majority of the property is prime for conservation and environmental stewardship. The 1,800 feet of shoreline hosts critical native fishery habitat along with acres of important wetlands, streams, and woodlands that are home to plants, birds, and wildlife. A small upland section has been identified for critically needed workforce housing that aligns with community priorities.

IMPORTANT PRACTICAL DETAILS FOR THE WALK

Entrance and parking: Thanks to the kind permission from a neighboring property, we will enter and park directly across from the Lee Mann Rd intersection with M22. This property and entrance connects to the woodland and creek sections of the future nature preserve; and thus creates a shaded place for our walks to start and conclude. Please note we will not move the large NCV sign we have at our main entrance across from Overlook Road. Water, sunscreen, ticks, etc: Remember, this is a nature area with grassland meadows and woodlands! Long pants and closed toed shoes are recommended. Wearing sunscreen, a hat, and carrying water are recommended. The walk will be on a wide, mowed area yet there is poison ivy on the sides in some areas and the usual risk of ticks. Bring your binoculars to look for the many species of birds!

Rain policy: Walks will proceed if light rain is forecast. Please provide your cell phone number when signing up so we can contact you to reschedule if there is inclement weather.

Dogs: In the context of these hosted, small group walks, we request that you do not bring your dog(s).

RELEASE AND WAIVER OF LIABILITY

WHEN VISITING THE FORMER TIMBER SHORES PROPERTY

By visiting the former Timber Shores property with a Board member, docent or agent from New Community Vision, as an Invitee to the property I agree to this RELEASE AND WAIVER to New Community Vision (“Volunteer Guide”) and to BFO Investment Company, LLC (the “Owner”) and all of both organization’s agents, volunteers, members, owners, and affiliates in consideration of New Community Vision and the Owner permitting an Invitee to enter upon, tour and explore a portion of the former Timber Shores property that is generally located in Leelanau Township, Leelanau County, Michigan. Accordingly, by agreeing to visit the property with a Volunteer Guide, I hereby state, promise, and agree as follows:

1. To remain on mowed paths and identified and/or obvious two-track trail. Approval is not given to leave the trail area and explore other areas of the property.

2. Not to enter Lake Michigan, any small harbors or bays, Ennis Creek, or any other waterways or tributaries.

3. Not to bring dogs or young children when visiting the site.

4. Recognize and acknowledge that visiting the former Timber Shores property presents certain inherent and unavoidable risks of physical injury to the undeveloped and wild nature of the property to all guests, minor children or ward, any event invitees, associates, naturalists, bird watchers, independent contractors, or anyone else entering or visiting the property by invitation (the “Invitees”). Invitees voluntarily agree to assume the full risk of all injuries, damages, or loss, regardless of severity, that any Invitees may sustain as a result of visiting the former Timbers Shores property. Invitees agree to waive, release, and fully discharge any and all claims the Invitees minor child/ward or guests may have against Volunteer Guides and the Owner, including any and all of its officials, agents, board members , directors, volunteers, and employees (hereinafter collectively referred to as the “Owner Releasees”) arising out of, connected with, or in any way associated with visiting and any use of the former Timbers Shores property.

5. Invitees agree to indemnify, defend, and hold the Volunteer Guides, the Owner and Owner Releasees harmless from and against any and all liability for claims of whatever nature (collectively, “Claims”), whether to person or property, whether direct or indirect, arising out of the entry onto the Timber Shores Property by me or my Invitees.

6. Invitees understand that neither the Volunteer Guides, its docents or agents, Owner nor any of the Owner Releasees shall bear any responsibility relating to any costs that any Invitees may suffer as a result of injury, illness, accident, death, loss, or damage to person or property (the “Costs”), and I acknowledge and agree that such Costs are part of my indemnification responsibility herein.
